Pricing, stock levels, and product information on this website are indicative and subject to change without notice. They do not constitute an offer capable of acceptance; a binding sale occurs only on our acceptance of an order, in accordance with Bernsport's separate terms and conditions of sale.

This website is intended to be accessed by New Zealand trade customers. We make no representations about the compliance of this site with the laws of any other country. If you access this website outside of New Zealand, you do so on your own initiative and are responsible for compliance with local laws.
These terms are governed by the laws of New Zealand. Each party submits to the non-exclusive jurisdiction of the courts of New Zealand in relation to any dispute arising out of or in connection with this website.
Privacy Policy
Bernsport is committed to handling personal information in accordance with the Privacy Act 2020 and the 13 Information Privacy Principles (IPPs).
What we collect: In the course of operating this trade website, we may collect personal information such as names, job titles, business contact details (email, phone, physical address), order and account history, and technical information such as IP address and browsing behaviour on the site.
How we collect it: Where practicable, we collect information directly from you (e.g. when you register an account or place an order). Where we collect personal information indirectly - for example, from a related company, a referral, or a public business register - we will, where required under IPP 3A, take reasonable steps to let you know this has occurred and why.
Why we collect and use it: We use personal information only for the purpose for which it was provided, including to:
- set up and manage your trade account and process orders;
- provide customer service and respond to enquiries;
- send account and order-related communications; and
- with your consent (or on an opt-out basis where permitted), send product updates and special offers.
We will not disclose your personal or business information to any other party without your permission, except:
- to our service providers who process information on our behalf (e.g. IT hosting, accounting/ERP systems, email platforms, delivery/freight partners) and only for the purposes we specify;
- where required or authorised by law; or
- as otherwise described in this policy.
Storage and security: We take reasonable steps, in line with IPP 5, to protect personal information against loss, unauthorised access, use, modification, or disclosure. Where personal information is held or processed by service providers outside New Zealand, we take reasonable steps to ensure it receives comparable protection, consistent with IPP 12.
Retention: We retain personal information only for as long as reasonably necessary for the purposes it was collected, or as required by law (for example, tax and business record-keeping obligations under NZ law).
Your rights - access and correction: Under IPPs 6 and 7, you have the right to request access to personal information we hold about you, and to request correction of that information if you believe it is inaccurate, incomplete, or out of date. To make a request, or to update your details or email preferences, contact us at orders@bernsport.co.nz.
Marketing communications: From time to time we may send you product information, including special offers, by email in accordance with the Unsolicited Electronic Messages Act 2007. Every such email includes an unsubscribe option, or you can opt out at any time by emailing orders@bernsport.co.nz.
Privacy breaches: If a privacy breach occurs that has caused, or is likely to cause, serious harm, we will notify the Office of the Privacy Commissioner and affected individuals as soon as practicable, in accordance with our obligations under the Privacy Act 2020.
Complaints: If you have concerns about how we have handled your personal information, please contact us first at orders@bernsport.co.nz. If you remain unsatisfied, you may complain to the Office of the Privacy Commissioner at www.privacy.org.nz.
Cookies
A cookie is a small piece of information stored on your device to help us improve your user experience when you use our website.
We primarily use 'session' cookies, which expire after 30 minutes of inactivity on this website. We also use some longer-lived cookies for internet statistics and remarketing purposes (see the section below). These may persist for longer periods and, when combined with data from advertising partners, can be used to recognise a returning browser/device. Cookies cannot damage files on you device and cannot read information from your hard drive. It is possible to disable cookies through your browser settings.
